Uniform Public Construction Cost Accounting Act (UPCCAA)

The Costa Mesa Sanitary District (CMSD) has adopted the Uniform Public Construction Cost Accounting Act (UPCCAA) as set forth in California Public Contract Code Section 22010, which allows the District to conduct Informal Bids for public works construction (sewer) projects from $30,000 to $125,000 (current legislation set the limits at $60,000 and $200,000, but the District did not avail itself to those increased limits).

CMSD invites all interested California contractors who are properly and currently licensed, subject to verification through the Contractors State License Board, to submit an application for inclusion on CMSD’s Informal Bidding Contractors List. All trade categories are subject to the Informal Bidding Procedures.

To qualify for CMSD’s Informal Bidding Contractors List, contractors are required to complete and submit the application below and meet the following minimum requirements:

  • Possess a valid California contractor’s license for the work to be performed;
  • All contractors and subcontractors to bidders must be registered and qualified to perform public work pursuant to Section 1725.5 of the California Labor Code, subject to limited legal exceptions under California Labor Code Section 1771.1;  
  • Meet all applicable safety standards under OSHA, state, and federal regulations;
  • Meet CMSD insurance requirements for UPCCAA projects. For more information about CMSD insurance requirement, please see below;
  • Pursuant to Part 7, Chapter 1, Article 2, Section 1770 et. seq. of the Labor Code of the State of California, the contractor and its subcontractors shall pay their labor forces not less than the general prevailing rate of per diem wages as determined by the State of California Director of Industrial Relations; and
  • Meet the bonding requirements, including a contract payment and performance bond. A bid bond or substitute securities for an amount of ten percent (10%) of the aggregate total bid may be required.

Professional Services Projects

CMSD uses the “Best Value” evaluation method for awarding professional services projects.

The working definition of “Best Value” is the most effective solution for the District based on an evaluation of:

  • Cost
  • The ability, capability and skill of a supplier to provide goods or services.
  • The character, integrity, reputation, judgment, experience and efficiency of a supplier.
  • Previous performance service to the District.
  • The ability of the contractor to provide future maintenance, repairs, parts and services related to the procurement.
  • Other factors that are determined to be important by the District staff person making the purchase.

All Other Purchases

For all other purchases, CMSD shall make use of competitive bidding, either direct, formal or informal and award will be made on the lowest responsive bid.

Insurance Requirements

In all instances where the contractor or Service Provider personnel enter CMSD’s property to repair, install, service, construct, consult etc., CMSD requires insurance verifying coverage pursuant to CMSD’s insurance requirements. Be prepared to provide proof of insurance coverage with CMSD named as additionally insured. The requirements below describe the coverage that has to be met by contractors and service providers.
